Terms and conditions
Article 1 – Orders
The fact of placing an order implies the full and unreserved acceptance by the buyer of these general conditions.
An order can only be accepted if it includes the full details of the buyer, the work(s) ordered, the chosen payment method, the date and his/her signature.
The payment method must be attached to the order: check, money order, or transfer to the account mentioned by the artist.
The photos of the works are not contractual.
The colors cannot be reproduced 100% identical to the original work.
Since the site is not always updated, check by email that the chosen work is still available.
Article 2 – Price
Prices are quoted in euros.
They do not include shipping and packaging costs.
The prices of the works sold are those in effect on the day the order is placed.
Article 3 – Characteristics of the works
Due to the printing technique or the appearance on screen, it may be that the colors or values (darker or lighter) do not exactly match the colors of the original work.
The tolerance for works on paper, subsequently mounted (for example at the time of shipping) is + or – 2 cm compared to the dimensions of the work specified on the website.
The works must be treated with certain precautions, which are common to all painting techniques:
– They must not undergo friction or shocks.
– They must not be exposed to sunlight, ultra-violet light, or infrared radiation.
– They must be kept in a cool, dry place (ideally between 15 and 20 °C).
– It is the stability of the temperature that matters. Do not expose above a radiator.
– The degree of hygometry must be between 45 and 55% relative humidity.
– The more stable an atmosphere is, the better it is for the preservation of works of art.
Article 4 – Payment
You can pay for your order by bank or postal check, or by bank transfer.
Orders can be placed by email, by mail or by phone in accordance with the content of article 1.
The work remains the property of the artist or his descendants until actual payment is received.
Otherwise, the restitution of the work will be requested.
In the event of cancellation of the transaction, the buyer shall reimburse the costs incurred in collecting the amounts due, including bailiff and attorney fees.
Under the 2008 Chatel law, the client may withdraw.
Article 5 – Reserved ownership
Law No. 80-335 of 12/05/1980: the goods sold, even if held by the buyer, remain the property of the seller until full payment is received.
We reserve the ownership of the delivered items until full payment of the price by the buyer.
Article 6 – Cost of delivery to mainland France
The price of the works is given excluding packaging and shipping costs. These will be specified at the time of payment.
The works are packaged according to the size and weight of the work. These are the elements that affect the packaging and shipping costs.
The greatest care is taken to ensure that they arrive in good condition.
They are entrusted to a carrier who, from then on, commits his responsibility.
Article 7 – Cost of delivery outside mainland France
The port cost varies depending on whether it is a shipment to Corsica, the DOM/TOM or abroad.
Article 8 – Cost of delivery to Metropolitan France
The deadline is the one announced by the carrier.
Exceeding deadlines cannot give rise to damages or cancellation of orders.
We reserve the right to cancel any order in case of force majeure.
Article 9 – Shipping and damages due to the career
Shipments transit at the recipient’s own risk.
It is essential to ensure receipt, delivery compliance, and the condition
of the package and the artwork in the presence of the delivery person. If the package is damaged, so is the work of art, despite the precautions taken to protect it at the time of packaging.
Any dispute with the carrier may only be filed by the customer.
In this case, please strictly require from the carrier an official certificate of damage or loss of the item. Date and sign and keep a duplicate. Mention on the delivery note of the carrier, the mention of your qualified reservations relating to the problem encountered. Your claims will only be admissible if they concern the goods contained in the package(s).
Delivery takes place within 4 days to 2 months in working days (especially in the case of foreign countries or complications due to fortuitous events).
Article 10 – Propriété intellectuelle
The intellectual property remains with the artist. Works purchased or even copied on the Internet or any other medium may not under any circumstances be used or reproduced without the express consent of the artist. This is the case for reproduction rights (books, posters, press, merchandising, etc.) for multimedia, private copying, photocopying, and lending rights.
Any reproduction or representation, in whole or in part, made without the consent of the artist is an infringement.
